Setting sponsor category exclusivity boundaries

A bank has asked to be the only financial sponsor, and nobody has decided whether payments companies or insurers count as financial.

The short answer

Exclusivity is a promise with edges. Write down the category, the scope in which it applies, the exceptions and what happens when a member or existing sponsor falls on the boundary.

Sell exclusivity only when you can describe it in a short paragraph that a competitor's lawyer and your own secretariat would read the same way.

Five edges every exclusive category needs

  1. Category definition: which kinds of organisation are inside, with examples and near-misses listed.
  2. Scope: this event only, one day, one programme track, one physical area, or the whole year of association activity.
  3. Benefit type: exclusive to be named, exclusive to exhibit, or exclusive to speak.
  4. Exceptions: existing association sponsors, government bodies, speakers, exhibitors and delegates employed by competitors.
  5. Conflict route: who decides a new borderline case and how the exclusive sponsor is told.

Where boundaries usually blur

  • A group company or subsidiary that works in the same category under another name.
  • A speaker from a competitor invited on merit, who is not a sponsor but will be on stage.
  • An association-level sponsor that already has year-round rights covering the event.
  • A venue or catering supplier with its own branding in the room.
  • Digital rights, such as the event app or email, that were sold separately from the physical event.

Decide what the sponsor cannot control

Exclusivity limits what you sell. It does not give a sponsor power over your speaker choices, delegate list or editorial agenda, and it should say so in plain words.

Ask your legal adviser whether exclusivity terms raise competition or contract questions for your association, and put the wording to them before you publish it.

Record it where conflicts can be seen

Hold every exclusive right in one register with category, scope, dates, holder and exceptions. Use the rights conflict checker to flag duplicates inside the same defined scope, and treat its output as a prompt for review, not a legal interpretation.

A fictional accounting body defines exclusive categories

Institut Fiktif Perakaunan Digital offers one exclusive sponsor in the category audit software. The definition lists software vendors for audit workflow and names three adjacent types, cloud accounting, tax software and training providers, as outside the category.

Scope covers the annual congress only. Two exceptions are stated: a speaker from any vendor may be invited by the programme committee, and the institute's existing year-round partner keeps its own rights. The secretariat sends the exclusive sponsor the written definition before signature.

Handle it in-house, or bring in help?

Your team can usually handle this when

  • Your categories are few and easy to define.
  • No association-level sponsor already holds overlapping rights.
  • The committee will write the definition down before selling.

Outside planning help earns its fee when

  • Several committees sell different rights in overlapping categories.
  • An existing year-round sponsor holds rights that touch the event.
  • A senior member has already promised exclusivity verbally.

Questions organisers ask

Should we offer category exclusivity at all?

Only if the benefit is worth the trade-off. Exclusivity narrows who you can approach, so offer it where one sponsor clearly values it and where you can describe the category precisely.

Does exclusivity cover the speakers?

Say explicitly that it does not, unless the programme committee decides otherwise. Editorial choices stay with the organiser. See speaking opportunities.
