The short answer

An embargo is an agreement, not a label. Only material sent with a clear release date and time, and accepted by the recipient, can be treated as embargoed.

Agree the terms before you send the content, put them at the top of every message, and keep a list of who received what.

What an embargo needs to state

  • The exact release date, time and time zone, written out in full.
  • What exactly is held: the announcement, the figures, the speaker names, the photos.
  • Who may see it before release and who may not, for example internal staff only or named journalists.
  • What happens if the date moves: you will send a new notice, and the old time no longer applies.
  • Who to contact with questions, one named person.

Who to tell, in what order

  1. Internal approvers first, so the wording and date are agreed before anything leaves the building.
  2. Speakers, sponsors and partners named in the material, who may have their own release plans.
  3. Media contacts you have a working relationship with, only after the first two groups have confirmed.
  4. Keep a record of each recipient, the date sent and whether they acknowledged the terms.

Where embargoes fail

  • The notice is in the email body but the attachment file name or preview reveals the content.
  • A sponsor's communications team schedules a post for the same morning without knowing the time.
  • The embargo time is written in one time zone and a regional recipient reads it in another.
  • The date is moved and an earlier version of the notice stays in someone's inbox.
  • Nobody asked the recipient to confirm, so nobody can say who accepted.

Questions for your legal or communications adviser

Whether an embargo is binding on a recipient, and in what way, is a matter for a competent adviser. Take these questions to them.

  • Do we need a written agreement, or is an acknowledged email enough?
  • How should we treat material that includes personal data of speakers or attendees?
  • What wording is appropriate if the recipient is a regulator, a government office or a listed company?
  • What should we do if an embargo is broken?

Worked example · Fictional example

Holding a keynote announcement for an association summit

Fictional organisation and figures, to show the level of detail that is useful.

The fictional Persatuan Fiktif Pengurusan Logistik wants to announce its keynote speaker at 10:00 on a Tuesday, together with the summit date. The speaker's employer plans its own post.

The secretariat first agrees the time with the speaker's communications officer, then sends the notice to eight named media contacts with the release time in the subject line. Six reply to confirm. Two do not, so those two receive a second request and the secretariat does not assume they have accepted.

Handle it in-house, or bring in help?

Your team can usually handle this when

  • You have a small, known list of recipients and one release time.
  • The material is approved and unlikely to change.
  • Nobody outside the committee has been briefed informally.

Outside planning help earns its fee when

  • Several organisations plan their own releases around the same date.
  • The material may change after approval and each change needs a fresh notice.
  • Recipients span regions and you need to coordinate times and languages.

Questions organisers ask

Can we embargo something already shared in a members' newsletter?

Not effectively. Check what has already gone out and to whom before you set a release time, and record it.

Do we need every recipient to confirm?

Ask each to confirm. An unconfirmed recipient should be treated as not having accepted the terms, and you may decide to send the material later.

What if a sponsor wants an earlier release?

Take it to the approver named on your release plan. Do not agree changes by phone without recording them.

Where do speaker photographs fit?

Check the presentation permission register and the recording permissions before including them.
